The thought of being seriously hurt while riding the bus isn’t something anyone thinks about, but it’s still important to know your rights – just in case. In fact, most people aren’t aware of a crucial change that took place in 2011, regarding accident claims after being seriously hurt while on a bus. It might seem obvious that if you are injured on a bus receiving compensation is automatic, but getting the compensation you deserve won’t come without bringing your personal claims to court.

Commonly referred to as the “No Crash, No Cash” rule for accident claims, this is a real game changer for all of Ontario. It states that if you have been injured while on a bus, that bus must be involved in a collision in order to allow statutory accident benefits to be granted. Simply put, if the bus stops suddenly and doesn’t hit something, but you sustain an injury, accident claims will need to be presented in court if you have any hope of being compensated.

Our own Miryam Gorelashvili dealt a case like this in the past, and had this to say, “It’s outrageous for plaintiffs”. In an article describing how the changes to accident claims affected Miryam’s client, it highlighted a problem that has a great impact on those injured while taking transit. All it takes is the driver to accelerate or brake when you’re not ready to result in falling and acquiring a serious injury. For the full story, follow the link here.
