Important steps to take when injured
It’s important to remember that injuries can take some time to present themselves. If you’ve been in a bad accident, it’s important to take these steps regardless of how you feel, as it may take a few days or weeks for the full extent of your injuries to become apparent.
Police reports are a valuable part of any court proceeding, so ensuring that the police have all the information you have available will reflect positively on your case.
What are long-term disability benefits?
It’s important to note that long-term disability benefits differ from short-term disability benefits. Essentially, long-term disability insurance benefits (LTD) are an income replacement benefit when serious injury or medical conditions prevent you from performing your job. Many employers offer them as part of their group benefits policy. Typically providing up to 60% of your gross salary with a monthly limit for the period in which you can’t work, it’s available after short-term disability insurance, sick leave and EI benefits have been exhausted.
How do I qualify for long-term disability benefits?
Disability must affect your life for a minimum of two years to qualify. You need to supply medical evidence of your mental, physical or psychological ailments that prevent you from performing your job at your usual level. Essentially, an inability to work must be supported by the physicians looking after you.
What kinds of disability are typically associated with long-term disability benefits?
Usually those with permanent damage, including the loss of a limb, spinal cord injury, cancer, a stroke, a heart attack, paralysis, or psychological disorders.
How much time are disability benefits valid for?
You will qualify for long-term disability if you cannot perform the duties of your employment. It does not matter if you can perform other jobs, as long as you cannot perform the duties of your job. After 24 months, there is a change in the disability definition. The definition changes from “own occupation” to “any occupation” and if you qualify, the benefits will be paid until the age of 65. Bear in mind, the definition of “disability” differs between insurance companies. In some cases, it can differ between insurance plans from the same company too.
How much can I expect to receive from long-term disability benefits?
The amount will depend on the type of policy you have. In some cases, benefits can equate to 50% to 85% of your regular monthly income.
What if my claim for long-term disability benefits is denied?
You should seek legal advice from MG Law’s long-term disability lawyers right away. Some policies have a very short limitation period and you won’t be able to appeal the decision or pursue litigation after six months of the denial.
