How do you prove a product liability case?
Product liability cases need to prove two things – defect and negligence. You must be able to prove that the product was indeed defective, and that the manufacturer was aware of the defect. You must be able to prove that you were harmed as a direct result of the product, whether that was during use (such as cutting yourself) or during storage (such as a fire). Additionally, you need to prove that the manufacturer made and continued to sell a product they knew had a flaw or was dangerous.
There are three distinct categories that product manufacturers can be held liable for:
- Manufacturing – These are defects or issues with the product that occurred during the production of the item. This can include many things, such as missing pieces or ingredients or accidentally added pieces or ingredients that make a product unsafe.
- Design flaws – These are issues or defects in the product that are a result of the design of the product. A big reason that many companies perform research and testing before releasing a product to the market is to avoid design flaw lawsuits.
- Lack of warnings – These are issues or injuries that stem from a lack of adequate warnings associated with the product. These issues could stem from an appliance not including proper cleaning instructions, or a prescription medication not including possible side effects of its use.
What products are covered under product liability?
It has been decided by the Supreme Court of Canada that all manufacturers owe a duty to consumers of their products. This duty is to ensure there are no defects in the manufacturing, which may give rise to injury with ordinary use. They also must not manufacture their products in a defective way if there are more reasonable alternatives available. It is the manufacturer’s duty to warn consumers not only of dangers known at the time of sale, but also of any dangers that become known after time of purchase. These warnings must be communicated to the consumer is a clear and reasonable way.
Essentially, product liability refers to all products. This includes bigger purchases like vehicles, household appliances, tools and machinery, as well as smaller, everyday purchases such as food, children’s toys, and medication.
